Terms of service


1. THE FACILITY: I acknowledge and assume risk of any personal injury sustained on or about the Niagara's BEST Summer Camp! (NBSC!) premises. I understand that all personal property kept, placed or left on or about the premises of Niagara's BEST Summer Camp! (NBSC!) shall be at my sole risk as to loss, theft, or damage, and NBSC! shall have no responsibility for any such incident.


2. SUPERVISION AND CARE: I understand that Niagara's BEST Summer Camp! (NBSC!) is a summer camp and not a daycare as such, their stock-in-trade is not supervision and care. The intent of NBSC! is to teach physical and philosophical character building skills. Additionally, if my child(ren) stays at the NBSC! facility it is because of my direction. I also understand that when NBSC! has dismissed a child to a parent, guardian, or individual for whom NBSC! has a Guardian Release Form, that child is now under the supervisory responsibility of the parent/guardian and no longer of NBSC! and its representatives.


3. PHOTO RELEASE: I consent that photographs may be taken and video recordings may be made of my child by Niagara's BEST Summer Camp! (NBSC!), its affiliated and related companies and each of their respective directors, officers, owners, employees, representatives and authorized agents during my child’s participation in Niagara's BEST Summer Camp! (NBSC!) activities. I understand that I will not be compensated in any way for any photo that is used, published or displayed by the Niagara's BEST Summer Camp!. Such photographs and video recordings may be used by NBSC! for current and future marketing activities and promotional materials, in both print and electronic format,  including, but not limited to: publications, videos, multimedia productions, displays, posters, brochures, advertisements, newsletters, media coverage, and on its website or social media websites, without further notice to me or without my approval of the finished photographs, videos or audio recordings.


4. WAIVER & RELEASE: WAIVER & RELEASE: Buyer and Student(s) agree that the student(s) is/are engaging in physical exercise, the use of equipment, and the use of Niagara's BEST Summer Camp! and instruction facility, which can be dangerous to the student(s) and could cause injury to student(s). Student(s) is/are voluntarily participating in these activities and buyer and student(s) assume all risks of injury to the student. Buyer and student hereby waive and release any claim or right to sue Niagara's BEST Summer Camp!, employees or agents for injury to patron(s) and camper(s) in attendance. Buyer and/or student have carefully read this waiver and release and fully understand, it is a release of all liabilities and damages to Niagara's BEST Summer Camp! because of any injury that may occur. Niagara's BEST Summer Camp! will make no evaluation or recommendation whether student(s) or guests are physically fit for any exercise activities. It is always advisable to consult your physician before undertaking a physical exercise program, including martial arts activities and bouncy castles. I hereby release, discharge, and hold harmless NBSC!, its employees, agents, and representatives, of the above claims and liabilities. NBSC management may excuse and remove any camper and/or family from the camp for ANY reason, including behavioural issues at NBSC's discretion, without refund our recompense. Children displaying behaviour not limited to, but including uncooperative, violent, sexual, emotional abuse against people or animal, or other forms of cruelty not limited to hitting, pushing, biting, swearing, bullying, flashing body parts, or a lack of preparedness for camp. Children without proper clothing or sufficient supplies to successfully thrive in camp, including but not limited to food, foot wear, water bottles, hats, and sunscreen, will be removed at NBSC management's discretion.


5. CONCUSSION PROTOCOL: I agree to annually review NBSC!’S Concussion Protocols, review and sign NBSC!’s Concussion Code of Conduct, and review the associated concussion resources provided to me by NBSC!. I also acknowledge that it is my responsibility under O.Reg. 161/19: Rowan’s Law to annually review Ontario’s Concussion Awareness Resources. 


6. HEALTH AND PHYSICAL WELL-BEING: I understand that sharing pertinent medical information with NBSC! is important for my health and wellbeing or that of my dependent. I assume all risk of not divulging such pertinent medical information to a NBSC! representative. I also understand that NBSC! will treat this medical information as private, and as such it will not be shared, presented or made public in any way other than to assist in the prevention of injury to the signatory (you or your child) below. 


7. PAYMENT INFORMATION: NBSC! does not issue refunds, but as a courtesy, credit may be issued for services, equipment, or uniforms at the management’s discretion. All cancellations and withdrawal requests will be granted at the discretion of the purchaser, without refund. Registrants requesting refunds within 10 business days of purchase may be granted a refund under the Consumer Protection Act. In the event of a refund, 10% will be held back as an administration fee. Registration may be cancelled and refunded for any reason under NBSC! Discretion including but not limited to COVID related government orders and lack of registration in NBSC!.


8. COVID-19: I understand the contagious nature of COVID-19 and voluntarily assume the risk that I or my child(ren) may be exposed to, or infected with, COVID-19 by attending NBSC! and that such exposure or infection may result in personal injury, illness, permanent disability, or death. On my behalf, and on behalf of my children, I hereby release, discharge, and hold harmless NBSC!, its employees, agents, and representatives, of and from all claims, including all liabilities, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of NBSC!, its instructors, volunteers, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any NBSC! classes or programs. Finally, by attending class and other programs at NBSC!, you confirm that you, members of your direct household or your guests: have not travelled out of province or out of the country in the last two weeks, have not been in contact with anyone identified as COVID-19 positive or showing symptoms of COVID-19; and, do not feel sick or show any COVID-19 symptoms (such as fever, cough, sore throat, runny nose, or headache). You also agree that if you or your child(ren) develop COVID-19 symptoms or feel sick, or if you are living with a person who has such symptoms, that you will not come to NBSC! and you will stay at home and self-isolate. If you are under a government mandated self-isolation period, you are required to complete it before returning to NBSC!.
