Agreement Introduction and DefinitionsIncomplete

This Agreement must be completed by the parent or legal guardian of each child before the child may attend Niagara’s BEST Summer Camp! “Niagara’s BEST Summer Camp!”, “NBSC,” “Camp,” “we,” “us,” and “our” mean the Niagara camp program operated under the name Niagara’s BEST Summer Camp! by Manotick’s BEST Summer Camp! Incorporated.

By signing, I confirm that I am the parent/legal guardian with authority to register the child or children listed on this form, and that all information provided is complete, accurate, current, and not misleading.

“Participant” means the registered child or children. “Releasees” means NBSC, its corporate operator, shareholders, directors, officers, employees, contractors, staff, volunteers, agents, insurers, facility owners, service providers, and others involved in operating or supporting Camp.

1. Nature of Camp, Age Requirement, and EligibilityIncomplete

NBSC is a recreational day camp for children who are at least 4 years old on or before their first day of Camp. NBSC is not a licensed child care centre.

Camp activities may include indoor and outdoor games, sports, martial arts-inspired activities, arts and crafts, theme activities, water activities, special events, and other recreational programming.

If a child is underage, ineligible, inaccurately registered, or cannot safely participate in the Camp environment, NBSC may refuse attendance, remove the child, terminate registration, or refuse future registration, subject to applicable law.

2. Accuracy of Information and Required DisclosureIncomplete

I confirm that all registration, payment, age, medical, allergy, medication, behavioural, developmental, custody, emergency contact, pickup, and safety information provided to NBSC is complete, accurate, current, and not misleading.

I understand NBSC relies on this information for eligibility, safety, supervision, staffing, and emergency response. Failure to disclose important information may result in refusal, suspension, removal from Camp, termination of registration, and no refund except where required by law.

3. Assumption of Risk, Waiver, Release, and IndemnityIncomplete

I understand that Camp involves normal risks associated with active children’s programming, including slips, trips, falls, collisions, minor or serious injury, illness, allergic reactions, heat or weather-related concerns, emotional distress, property loss, and property damage.

I voluntarily register the Participant for Camp and accept the risks of participation, including risks arising from activities, equipment, facilities, outdoor areas, public spaces, other children, staff, parents, third parties, weather, and ordinary negligence, except where such release is prohibited by law.

To the fullest extent permitted by law, I release the Releasees from claims connected with the Participant’s registration, attendance, participation, presence at the facility, emergency care, removal from Camp, or Camp activities, including claims in any court, tribunal, or Ontario Small Claims Court, except where such release is prohibited by law.

To the fullest extent permitted by law, I also waive claims for punitive, aggravated, exemplary, emotional harm, mental anguish, upset, inconvenience, disappointment, or other non-economic damages, and I agree to indemnify and hold the Releasees harmless from claims, costs, damages, legal fees, unpaid fees, chargebacks, inaccurate information, or losses arising from the Participant’s attendance, behaviour, or my obligations under this Agreement.

4. Controlled-Access Facility, Public Areas, Sign-In, and Pick-UpIncomplete

NBSC may operate in a controlled-access Camp area within a shared or public facility. Parents/guardians, emergency contacts, and pickup persons must follow all sign-in, sign-out, pickup, identification, safety, facility, and staff instructions.

Only parents/guardians, listed emergency contacts, and authorized pickup persons may pick up a Participant unless NBSC receives written instructions and accepts them. NBSC may require photo identification and may refuse release if staff cannot verify identity or authority.

Pickup must follow NBSC’s sign-out process. Parents/guardians and pickup persons may not enter Camp activity areas, mats, rooms, or other restricted areas to retrieve a child unless NBSC staff expressly permit it.

Parents/guardians are responsible for the Participant before sign-in, after sign-out, and in parking lots, entrances, exits, washrooms, hallways, public areas, and other shared spaces unless the Participant is under NBSC’s direct Camp supervision.

5. Parent/Guardian Availability, Late Pick-Up, and AuthoritiesIncomplete

A parent/guardian must remain reachable during Camp hours and must arrange prompt pickup if NBSC determines a child is ill, injured, unsafe, disruptive, distressed, or required to leave Camp.

Pickup deadlines depend on the package selected for each child and week. Core pickup is no later than 4:00pm. Plus and Max pickup are no later than 5:00pm. Late pickup fees apply per child based on that child’s applicable deadline.

If NBSC cannot reach a parent/guardian or emergency contact, or if a child is not picked up within a reasonable time, NBSC may contact appropriate authorities, emergency services, child welfare, police, or other agencies as needed.

6. Medical Consent, Illness, Communicable Illness, Vaccination, and ConcussionIncomplete

I authorize NBSC to seek or arrange first aid, emergency care, ambulance transport, clinic or hospital care, x-rays, tests, treatment, medication, injections, anesthesia, surgery, or other reasonable care for the Participant if NBSC or attending medical professionals believe it is necessary or appropriate. I am responsible for related costs not covered by public or private insurance.

I agree not to send a child to Camp who is ill, contagious, unsafe to participate, or required to stay home under public health, school, medical, or NBSC guidance. NBSC may refuse attendance or require pickup for illness, communicable illness symptoms, fever, vomiting, unsafe behaviour, suspected concussion, injury, or medical concerns.

I confirm that the Participant has received immunizations required for Ontario public school attendance unless a lawful exemption applies, and I agree to disclose relevant medical, allergy, medication, illness, injury, concussion, behavioural, or safety information before attendance and as it changes. Any medication approved for Camp must be provided in its original container and clearly labelled with the child’s name, instructions, dosage, and expiry date where applicable.

7. Behaviour, Removal, Parent Conduct, and No Refund Upon RemovalIncomplete

NBSC may set and enforce behaviour, safety, respect, and participation expectations. NBSC may remove or refuse a child who is unsafe, aggressive, threatening, repeatedly disruptive, unable to participate safely, or whose needs exceed what NBSC can reasonably support in a recreational day camp setting.

Parents/guardians and anyone they bring, invite, send, designate, or authorize in connection with Camp must communicate and behave respectfully, professionally, and safely with staff, children, families, facility representatives, and members of the public. The parent/guardian is responsible for the conduct of those persons.

Aggressive behaviour, intimidation, threats, insults, swearing, harassment, discrimination, unsafe conduct, or comments about staff appearance, body, clothing, voice, accent, manner of speaking, age, perceived age, maturity, personality, personal life, background, or other personal characteristics may result in removal, termination, or refusal of future registration.

If a Participant is removed or registration is terminated for behaviour, safety, parent conduct, inaccurate information, non-payment, or failure to follow Camp rules, no refund, credit, transfer, or compensation will be provided except where required by law or expressly agreed to in writing by NBSC.

8. Supplies, Personal Property, and Damage to PropertyIncomplete

Parents/guardians are responsible for sending each child with appropriate food, water, clothing, footwear, sun protection, medication if required, and any supplies requested by NBSC.

NBSC is not responsible for lost, stolen, damaged, or misplaced personal property. Personal toys, electronics, valuables, and non-required items should be left at home unless NBSC gives permission.

Parents/guardians are responsible for damage, loss, cleaning, repair, replacement, labour, contractor, administrative, or other expenses caused or contributed to by the Participant, whether intentional, reckless, careless, accidental, unsafe, or rule-breaking, including damage to NBSC property, facility property, staff property, camper property, third-party property, equipment, supplies, washrooms, walls, floors, doors, windows, vehicles, or outdoor areas.

9. Payment, Refunds, Credits, Cancellations, and ChargebacksIncomplete

A space is not reserved until payment, registration forms, and required consents or waivers are completed and accepted by NBSC.

Camp fees are non-refundable except where a refund is required by law or expressly approved by NBSC in writing. NBSC may choose to offer a credit, transfer, substitution, or partial credit, but doing so does not create an entitlement to future refunds or credits.

NBSC may cancel, modify, combine, relocate, reschedule, or discontinue any week, activity, theme, staffing arrangement, location, or program component due to low enrollment, facility issues, safety concerns, staffing issues, weather, public health guidance, emergency, government order, force majeure, or operational necessity.

I agree to contact NBSC in writing to resolve payment concerns before initiating a chargeback or payment dispute. For valid charges, I remain responsible for amounts owing, chargeback fees, collection costs, legal fees, and administrative costs, subject to applicable law.

10. Photo/Video, Communications, Privacy, Records, and General TermsIncomplete

I authorize NBSC to contact parents/guardians, emergency contacts, and authorized pickup persons by phone, text, email, or other reasonable method for Camp-related purposes, including registration, billing, scheduling, safety, illness, behaviour, pickup, lost items, and operational updates.

I authorize NBSC to collect, use, store, and disclose personal information as reasonably necessary for registration, payment, Camp administration, supervision, safety, emergency response, communication, legal compliance, insurance, dispute resolution, and operation of Camp.

NBSC may maintain registration forms, waivers, incident reports, payment records, attendance records, behaviour notes, medical notes, communication logs, and other Camp records as business records for administration, safety, insurance, legal compliance, and dispute resolution.

I consent to NBSC photographing, filming, recording, or otherwise capturing the Participant during Camp activities and using such media for Camp-related purposes, including marketing, advertising, social media, website content, brochures, newsletters, promotional videos, parent communications, and future promotional materials, without further notice, approval, or compensation.

I agree not to make false, misleading, defamatory, harassing, or malicious statements about NBSC, the Releasees, staff, campers, families, or the facility. This does not prevent truthful statements, good-faith complaints, communications with regulators, participation in legal proceedings, or rights that cannot be restricted by law.

This Agreement is governed by Ontario law. If any part is invalid or unenforceable, the remaining parts continue in force. This Agreement, registration forms, payment terms, Camp rules, and written NBSC policies form the agreement regarding the Participant’s registration and attendance. This Agreement may be signed electronically, online, by checkbox, typed name, drawn signature, scanned signature, or physical signature.
